Employment on 15 November 2022 requesting, under the Official Information
Act 1982, the following information:

 

“Please provide a copy of the ADEPT User Guide, and any other relevant
guides, SOPs, emails, or documents in any form that a processing officer
might be informed by when completing any task in the ADEPT system.”

 

We have identified that your request for the relevant SOPs and emails
encompass large amounts of material. These parts of your request are
likely to be refused in reliance on section 18(f) of the Act as they would
require substantial collation. This decision has not yet been made, and we
would like to consult with you about narrowing the scope of your request
before doing so.

 

Could you please narrow down your request for SOPs and emails to:

o The product type that you are after (i.e. 2021 Resident Visa,
Accredited Employer Work Visa, Visitor Visas)
o The nature of the guidance you are after (e.g., manual assessment
tasks against immigration instructions, automatic tasks, or
administrative tasks)
o Within a specific timeframe (e.g., emails sent since August 2022)

 

Please respond to us by Thursday, 24 November 2022. If we do not receive a
response by this date we will proceed without rescoping.

 

If your request is rescoped, it may still encompass a large amount of
information. While we have not made a decision at this stage, we are
likely to need to extend your request for collation of material, and /or
to undertake necessary consultation. We are happy to discuss this request

Dear Business Management Team,

Thank you for your response.

The information I requested encompasses only the guidance specific to the ADEPT system that a processing officer might rely on to complete a task in the system. If this information is able to be rapidly read and learnt by each processing officer, I don't think it is reasonable to argue that its collation would exceed the threshold of being 'substantial'.

The nature of the information requested - i.e. what is being relied on when completing tasks relating to INZ's core role of issuing visas - is significantly in the public interest. On this basis I believe there is a case for releasing the information even if its collation is judged to be substantial.

Please bear in mind that time spent deciding whether to release information, and an organisation's own administrative failings cannot be taken into account when determining whether a request constitutes substantial collation. If the decision is made to refuse my request under section 18(f), please provide details of alternate ways that the request could have been fulfilled and the reason it was not fulfilled in that manner, as well as a copy of the sample exercise undertaken - both of which should be done per Ombudsman guidance.
