I would like to request information regarding the protocol for Mâori owned
land exemptions and the role of a development contribution commissioner.”

 

We have also discussed your request with the Local Government branch
within the Department. We are unclear on the exact information you are
seeking and we wish to invite you to clarify the scope of your request.

 

There seems to be a misalignment between the section of the Local
Government Act you have referenced (s199K), and nature of your question
relating to possible exemptions for Maori Land.

 

Section 199K of the Local Government Act 2002 does not relate to
”exemptions for Maori land” (as implied in your request), but sets out the
additional powers of the development contributions commissioner (including
the power to make an order that prohibits the disclosure of any
information supplied to the commissioner to avoid “serious offence to
tikanga Maori or to avoid the disclosure of the location of wâhi tapu” as
set out in section 199K(4)(a)). We are keen to understand which aspect of
section 199K you are seeking information on. In particular, we are keen to
hear from you on whether you intended to seek information about orders
issued under section 199K(4)(a). Your clarification of this matter will
enable us to consider responding to this part of your request.

 

In addition, you seek information about the role of a development
contributions commissioner.  Section 199F(1) of the Local Government Act
provides that development contributions commissioners decide on
development contribution objections. What particular aspect of this role
