Kia ora Cody

When the scope of a LGOIMA covers emails, the Official Information team will contact the staff involved and ask them to supply the emails required. When the emails are historic, are in email accounts of former staff members or cover a very vast amount of people, we can engage an EDiscovery process through the Council's cybersecurity team. However, this can only be done by delegated authority of Official Information Advisors or the Head of the Legal unit.

Could this not introduce the possibility that a staffer / Elected Member may deliberately conceal, or accidentally miss, emails that would otherwise have been required to be disclosed pursuant to an Act?

Hi Cody

Staff and elected members are aware of their obligations under the LGOIMA. To conceal or intentionally exclude relevant information would be in breach of these obligations.

It is not realistic for Official Information staff to collate every item of information on their own, particularly when they may not have a strong understanding of the topic. Therefore we rely on staff and elected members to provide the relevant information as per their obligations. The Official Information Team works closely with staff and elected members on requests to ensure the understand what is required of them under the LGOIMA and they have support to provide any relevant information requested so it can be assessed.
