Dear Wellington City Council,

I note Andrew Taylor, EHO has advised the cost of providing this Official Information is $125+GST. I wish to challenge whether this is a 'reasonable charge' as defined under the Local Government Official Information and Meetings Act 1987 Section 13:

(3) Where no such amount is prescribed, any charge fixed shall be reasonable, and regard may be had to the cost of the labour and materials involved in making the information available and to any costs incurred pursuant to a request of the applicant to make the information available urgently.

I can confirm this information is not urgently required.

The information requested is already required to be maintained under Section 8 of the Health (Registration of Premises) Regulations 1966 which states:

8 Record of registration
(1) Every local authority shall keep a record of all registered premises, and of all certificates of registration and all renewals thereof issued by it.

(2) The record shall in every case show—
(a) the name and address of the holder of the certificate of registration, who in every case shall be the actual occupier of the premises:
(b) the situation of the premises:
(c) the purpose or purposes for which the premises are registered:
(d) the date of the first registration under these regulations and the dates of any renewals thereof:
(e) every change in the occupation of the premises since the first registration:
(f) a statement of any conditions subject to which the registration was effected or any renewal thereof was granted.

(3) The record must be available at all reasonable times for inspection—
(a) by any employee of the Director-General of Health; and
(b) by any person designated under section 7A of the Act as a Medical Officer of Health, a Health Protection Officer, or an officer who has functions, duties, or powers under an enactment administered by the Ministry of Health; and
(c) in respect of food premises (within the meaning of the Food Hygiene Regulations 1974), by any officer (within the meaning of the Food Act 1981).

Given:
- this information must be readily available under the Act above;
- additional to the Act above, there are no further costs in collating the information; and
- the convention of the Official Information Act 1982 states that the first hour and 20 pages should normally be provided at no cost.

I do not accept $125+GST to be a reasonable charge and would agree to the information being provided being limited to one hour of effort in producing the report which I assume to be electronically available.

Can you please confirm the removal of the charge in light of the statements above.

This was a good result. An initial approach via phone implied this public information was already being sold by the council due to its commercial value.
I am sure the council would welcome the opportunity for this information to be in the public domain so the public can see which premises are registered and which aren't; as well as support the development of local food-related enterprises that wish to find registered premises to share.
