Work Visa Application refused

Response to this request is long overdue. By law Associate Minister of Immigration should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

RE: Application for a Work Visa refused due to: NO GENUINE ATTEMPT TO RECRUIT NEW ZEALAND CITIZENS OR RESIDENTS.

As stated above Edgardo's application was declined. Gladvale Farms Limited is/was his employer.

1. There is obviously a double standard applied as another of our Filipino workers, with exactly the same background and paperwork supplied was granted a work visa. Gladvale can provide details of this employee if required, however a check with Immigration NZ would reveal that information.

2. Gladvale Farms Ltd has its own website from where we advertise for staff. Gladvale previously did advertise on other sites, eg Fencepost.com however the level of response was as follows: Applicants that resides overseas and would require a visa: 15.
NZ Applicants: 4. Gladvale hired the 4 NZ applicants. They lasted less then 2 months with drugs and inability to do the work required the reason for their dismissal under the 90 day probation period. This was at the end of 2016 and the start of 2017. This was the final straw as over the 17 years Gladvale has been operating a similar result has occurred in 80 -85% of the people employed via other websites.
Our own website has gained quite a popularity and we receive employment applications from quite a high calibre of people usually. We have successfully employed 5 staff members and are in the process of employing another in a truck driving role.

3. Gladvale feels that Edgardo has been unfairly treated due to Gladvale's methods of gaining staff members. Gladvale will not change its stance nor should Immigration NZ impose its standards of what it thinks is a "genuine attempt" to employ NZ citizens/residents. Especially since it has proven to be a subjective one as evidenced by our other Filipino employee being granted a work visa under the same paperwork supplied by Gladvale.

4. Gladvale has also made a formal complaint to Immigration NZ through their website. Case Number CFS-00514-R7Z3T4
