The Police Manual chapter on "Production orders" (released in response to an OIA request here: https://fyi.org.nz/request/police_search... ) states that "New Zealand Police has agreed protocols with Telcos for obtaining call data information. See Telecom inquiries and the Vodafone Protocol in the Police Manual." I would like to request the following information under the OIA:

Thanks for your response. I've lodged a complaint to the Ombudsman. The relevant part:

The police identify the relevant "police manuals" as constituting commercial agreements between themselves and the companies concerned. The bulk of these agreements will consist of commercial terms and will therefore not fall under s6(c). Of course, its the interesting bits of the contract, relating to what information these companies provide and on what circumstances, which I'm interested in. But on those grounds, we already know what is provided: "call associated data" and content of telecommunications stored in the ordinary course of business, in accordance with the part 3, subpart 2 of the Search and Surveillance Act 2012 (the definition of "call associated data" is that from the s3(1) Telecommunications (Interception Capability) Act 2004, so we know exactly know what information will be provided: ingoing and outgoing numbers, call durations and locations). The assertion that the revelation of this fact will somehow prejudice the detection of offences is ridiculous, as the information is already in the public arena, in the form of statute.
