I am hereby requesting:

* Any, and all, information (such as manuals) held by Police in regards to Telecom (now Spark), Chorus, 2degrees and Vodafone, including (but not limited to) any fees they may charge to Police
* The full contents of "Schedule 8 : Cost recoveries" in the document "Agreement between Vodafone New Zealand Limited and the New Zealand Police for information requests and investigative assistance."

Dear DREW, Rodney,

I refer to letter dated 25 June 2015.

In your letter, you have said “The actual amounts and any details of the cost breakdowns paid by police to any provider are commercially sensitive and public release would place respective providers at a commercial disadvantage”

This is not a commercially sensitive arrangement, this is an arrangement that makes working with Telecommunications Companies and Police easier. Providers should not be making a profit on users information that the police has requested, this information can be requested via the courts, how ever Police and Telecommunications Companies work together to avoid judicial reach (and also accountability). It is for this reason I am making a request for this data again. Should you refuse, I would want this to be reviewed your superior, as this answer is not appropriate. Furthermore, it is in the public interest to have this data to know what taxpayers dollars are going towards for this information.

Disappointingly I sent information to the Ombudsman asking that this information be released as part of my complaint. The Ombudsman claimed that they had not received this, even through I had received email acknowledgement of the same and my complaint was closed. I have no further information on this matter.

Last update: Ombudsman advised that the information is definitely commercially sensitive, even though similar countries overseas with similar information freedom laws have released this information.
